Content of the Regulation:
Warmly welcome to all guests. We invite you to read the document, which will explain the rules of using our service. In case of any questions, doubts, in exceptional situations and for your convenience we encourage you to contact us. We will make an effort to ensure that each such meeting is not only a pleasure for you, but also an experience worth repeating.
All visitors and persons interested in the content of our website will be referred to as Customers. In our Service we provide you with various types of original Manufaktura MMS products, which can be viewed and bought on the website www.manufaktura-mms.com.
This document will be referred to as the Regulations. In it we explain the principles of functioning of the Shop, define the rights and obligations of the parties and the principles on the basis of which we will cooperate with you. We wish you a pleasant reading.
2. Definitions used
Regulations - these regulations. Within the scope of services provided by electronic means, the Regulations are "Regulamin" referred to in Article 8 of the Act of 18 July 2002 "o świadczeniu usług drogą elektroniczną" of the Polish law.

Internet Shop or Service - an Internet service run by the Owner, available in the Internet at the address www.manufaktura-mms.com, where the sale of products is conducted by means of the Internet teleinformation network.
Consumer - a private individual
Customer - Consumer, a legal entity or an organizational unit without legal personality, having the capacity to perform legal acts, who, in accordance with the principles set forth in these Regulations, makes an Order in the Online Shop.
Sales Agreement - an agreement for the sale of Goods within the meaning of the Civil Code Act, concluded between the Service Provider and the Customer, using the Online Shop.
Subject of the transaction - Goods listed and described on the website of the Internet Shop.
Goods - a movable item presented in the Internet Shop, to which the Sales Agreement applies.
Lining pattern - is a feature of the Goods offered, it is not an item for sale.
Order - a declaration of will of the Customer specifying unambiguously the type and quantity of Goods, aiming directly at the conclusion of the Sales Agreement.
Individual Order - an Order with properties specified by the Customer or closely related to his or her person.
Newsletter - a free service provided by e-mail which is a letter sent to the e-mail address where the Service Provider informs the Clients about new materials and events occurring within the scope of the Internet Shop activity.
3. General principles
The Owner of the Internet Shop has the right to make changes to the Regulations. Information about planned changes will be made available in advance on the website of the Internet Shop.
Orders and Individual Orders placed by Customers before the changes to the Regulations come into force shall be processed in accordance with the provisions of the Regulations valid on the day of placing the order.
All textual information and photos available on the Manufaktura MMS Internet Shop website are protected by copyright. The use of these contents and their presentation on other websites for commercial purposes without the Owner's prior authorization is not permitted.
The Customer using the Internet Shop is obliged not to provide content that is prohibited by law, e.g. content that promotes violence, defames or violates personal rights and other rights of third parties.
4. Information about the offer
All Goods offered in the Internet Shop are original, new, in accordance with the description, free from physical and legal defects, and have been legally introduced to the Polish market.
Lining patterns made available to Customers on the website of the Internet Shop in the category "Lining patterns" are not subject to sale. The Service Provider makes available to the Clients a pattern as a supplement to the Goods, in particular to the Goods whose description clearly indicates the possibility of selecting a Lining Pattern. Orders containing only a pattern shall be cancelled by the Seller.
The Seller has the right to introduce changes in the prices of the Goods offered by the Online Shop, has the right to introduce new Goods to the offer, as well as the right to organize and cancel various promotional campaigns. The Seller has the right to introduce changes in the descriptions of products offered by the Online Shop.
All prices available on the websites of the Internet Shop are gross prices in Polish zlotys.
5. Method of Order Execution
5.1. Customer's individual account
For your convenience, we provide the possibility of creating a Customer account on the website of the Internet Shop. Having an account is not required to place an Order, but it allows you to exchange information more effectively, build an individual order history, use additional privileges of regular customers announced on our website and through the Newsletter.
To create an account please use the link "Register", fill in the registration form and confirm your email address.
5.2. Selection of Goods
Using the search engine (at the top of the page) and menu (on the left) available from the main page, you have the opportunity to review the photo gallery presenting our offer. Each of the products of Manufaktura MMS available in the offer of the Internet Shop contains a description of its features such as dimensions, colour, material of which it was made, as well as its accessories and other features. By opening the website of a selected model you have the opportunity to observe the opinions of users and ask questions about the product to the Seller.
The website of the selected product contains additional information such as availability, possibility to make a purchase, approximate time in which the Seller can make a shipment. In addition, customers registered in the Online Shop, after logging in to their account can add reviews and products to the individual wish list.
Once you have selected an interesting Manufaktura MMS product, you should add it to your basket. This way you can continue shopping and start composing your Order.
5.3. Lining selection
In the next step we suggest you to choose a lining for the product model you are interested in. For this purpose, please refer to the gallery "Lining patterns" visible from the menu level. The model should be added to the basket similarly to the product.
If you purchase multiple products in one Order, we will contact you to finally confirm and match the Lining Pattern to the selected products.
If you are unsure (not specify) about your preferred Lining Pattern), we will make the selected product from a lining material selected by us.
5.4. Individual orders
Within the scope of its business activity, the Service Provider also realizes individual projects. If you are interested in changing the parameters of any of our products, you expect it to look differently, have other features tailored to your individual needs, please contact the Seller. After establishing and confirming the details of the realization we will gladly proceed to the execution of such an order.
Price, shipping date and warranty conditions will be determined individually after the details related to the implementation of such a design have been clarified. We invite you to contact us.
Please think carefully about such an Order as Personalized Goods are not returnable.
5.5. Placing an Order
The condition necessary for the Customer to place an Order is to read and accept the Regulations and its terms.
To continue shopping after selecting the Goods and Lining Patterns, go to the "Basket" page and then:
- select your preferred delivery method,
- select a payment method,
- correct the quantity of Goods in the basket,
- confirm by pressing the "place an order" or "order" button.
The next step is to fill in or correct the address data necessary for the shipment. At this stage it is possible to add additional information for the Seller. After confirming that you have read the Regulations, you can continue placing an Order by pressing the "Summary" button.
5.6. Conclusion of a Sales Agreement
At the last stage of placing an Order, all the information provided by the Customer is displayed on the website of the Online Shop for the purpose of their final verification, which takes place through the "confirm purchase" button. Pressing "confirm purchase" is the same as signing the Sales Agreement.
Acknowledgement of the Agreement will be displayed on the website and sent to you via e-mail.
Each change in the status of your Order will be sent by the Seller via e-mail. Customers registered on the website of the Manufaktura MMS Internet Shop have the opportunity to monitor the status of the Order in the customer panel.
5.7. Advance payment
After receiving the Order, the Seller waits for its confirmation and for an advance payment for the ordered Goods. We start the execution of the Order only after the payment for the entire Order is registered.
Customer Orders not paid within seven calendar days will be cancelled by the Seller, at the same time the Sales Agreement is cancelled.
5.8. Order processing time
The delivery time is counted from the moment when the payment of the full amount of your Order is registered, when it occurs the Seller changes the status to "accepted for processing". The customer receives an e-mail notification about the start of our work.
On the product page and in the confirmation of the Order in the category "dispatch in:" or "expected date of dispatch" we give you the time we need from the start of implementation to the moment of dispatch of the finished Goods.
In the case of an Order containing more than one product, shipment shall take place no later than the time required by the Service Provider to prepare the Goods with the longest lead time.
After completing the entire Order, Service Provider sends the prepared Goods to the address indicated by the Customer and changes the status of the Order, marking them as "shipped". The Customer will receive a notification containing the shipment number to the previously given e-mail address.
Once you have received the purchased Goods, we recommend that you first check that they are complete, in accordance with the Order and that they have not been damaged during transport.
If the delivered package or its content is a source of any doubts, please contact us. In the event of damage to the shipment at the time of delivery, you are obliged to prepare a damage report, which will facilitate the claim of the Seller against the partner performing the transport service. If package is totally damage simply do not pick up such delivery from delivery service man and contact us.
From the moment of delivery you have the right to resign from the Sales Agreement and the right to Manufaktura MMS guarantee for the purchased Goods.
5.11. Customer feedback
We encourage you to give an opinion on the products purchased in our shop. You can do this on the website of a selected model via the Internet Shop, social networking sites or by Contacting the Seller directly.
6. Available payment methods
Customers placing Orders via the Online Shop have the possibility to choose the following available payment methods:
If you choose to pay by bank transfer, the Customer makes a transfer to the Service Provider's account.

Execution of payments via Pay-Pal requires an account in this system. Details of this payment method can be found on our partner's website: www.paypal.com
For card payments, the payment operator is BlueMedia S.A. The types of payment cards supported are: Visa, Visa Electron, Maestro, MasterCard, MasterCard Electronic.
7. Shipping and delivery
The Service Provider shall send the Goods ordered in the Online Shop via partners providing transport services:

InPost sp. z o.o.
Fedex Express Poland sp. z o.o.
UPS Polska sp. z o.o.
DPD Polska sp. z o. o.
The purchased Goods are shipped via partner companies.
Shipping time and cost depend, among other things, on the method of delivery chosen when placing an order. In addition, the cost is influenced by factors such as the delivery address and the total weight of the ordered goods. The cost of shipping is automatically determined by our Online Shop.
In case of damage to the parcel at the time of delivery, the Customer is obliged to prepare a damage report, which will facilitate the claim of the Seller against the partner performing the transport service.
If you have any questions about shipping, please do not hesitate to contact us before placing your order. In particular, if the Goods are damaged during delivery, please contact us.
8. Warranty and complaints
All Goods purchased in our Internet Shop are subject to the quality guarantee of Manufaktura MMS products. It includes hidden technical defects and other hidden defects not resulting from the normal use of our products, which became visible during the warranty period.
All Goods are covered by a two-year warranty, calculated from the date on which you received our product. It is the obligation of the Service Provider to consider customer complaints throughout the warranty period.
Customers who are Consumers have the right to make a claim under the warranty rules described in Art.558 of KC (Act of the Civil Code of the Republic of Poland). Consumer may request:
termination of the Agreement
If you notice any disturbing symptoms while using our products, please contact the Seller who will forward the further steps of the complaint procedure. In such a case it is recommended to prepare a photographic documentation of the product and its defects, describe the reason for the complaint. It will also be helpful to prepare a confirmation of purchase and provide this information to the Seller.
If consultation with the Seller did not bring a solution, please send back to our address Contact defective Goods and confirmation of purchase. Within fourteen days we will consider your complaint.
In case of a justified complaint about the Goods, the damaged product will be repaired or replaced with a full product and sent back to the Customer. If there is no possibility of repair or replacement, the Customer will receive a refund of the cost of the purchased Goods.
9. Withdrawal from the contract
Customers of our Online Shop deciding to place an Ordinary Order have the right to withdraw from the Sales Agreement and to receive refund in accordance with the Act of 30 May 2014 "o prawach konsumenta" (on Consumer Rights) of the polish law.
The Customer may withdraw from the Sales Agreement concluded remotely with the Seller without giving any reason within 14 (fourteen) calendar days from the date of delivery of the Goods. The Customer shall then be able to use the Goods only to the extent necessary to ascertain its character, features and functioning. The Client withdrawing from the Sales Agreement may use the Goods only as it would be done in the Service Provider's stationary store. The Client is obliged to take care of the Goods until they are returned.
The right of withdrawal does not apply to Goods purchased as Individual Orders, Personalised Goods are not refundable.
The Service Provider guarantees to the Clients from whom the returned Goods does not show signs of use, is not damaged, is not incomplete, the Service Provider guarantees the return of cost the total amount of the purchased Goods without deductions, and the return of costs of its shipment to the Client. At the same time, the amount of the refund associated with the delivery shall be limited to the amount that corresponds to placing an Order when choosing the cheapest shipping option available.
The Service Provider has the right to make deductions for the amount of the return if the Goods returned by the Customer: shows signs of use, is damaged, is incomplete.
The Service Provider shall not cover the Client's costs related to the return of the Goods. Service Provider also does not accept returns of Goods sent as cash on delivery.
Service Provider makes a refund in the same currency and in the same way as the Customer chose when placing the Order.
In order to return the purchased Goods, Customer need to complete the return form (an example of the document is available on the website of our Online Shop in the "Returns" tab), attach the original sales receipt, secure the Goods and send back to the Seller to the address indicated in the section Contact with the Seller.
10. Processing and protection of personal data
In accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. ("RODO" in Poland and GDPR in EU), on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, as regards the personal data of individuals who are private individuals. And in accordance with the polish Act of 29 August 1997 on the protection of personal data. Service Provider Manufaktura MMS Marta Mazur-Sokołowska, based in Gliwice, at 33/7 Obrońców Pokoju Street, is the Administrator of Personal Data transferred by the Customers of the Internet Shop.
The Customer registering in the Online Shop and making purchases without registration agrees to the processing of personal data provided in the registration form and the Order form of the Online Shop run by the Service Provider.
Personal data are processed by the Service Provider for the following purposes:
- in connection with the necessity to perform the Sales Agreement on the basis of the Order placed by the Customer,
- in connection with the registration of the Customer's account in the Internet Shop,
- in connection with the handling of complaints made by the Customer,
- in connection with the handling of returns resulting from the concluded Sales Agreement,
- for marketing purposes, to send a Newsletter, to send commercial information by the Service Provider (applies only to Clients who have additionally agreed to send a Newsletter),
- due to the need to conduct tax clearance (applies to invoices),
The Service Provider processes the following customer data:
- e-mail address,
- phone number,
- adres korespondencyjny (ulica, nr domu, nr mieszkania, kod pocztowy, miasto, kraj),
- for companies, additional company data (name, registered office address, TAX number).
- bank account numbers,
The Service Provider provides Customers of the Online Shop service with a voluntary possibility to create a password-protected account.
Each Customer has the opportunity to access the content of their data and to correct them during the ordering process.
Each Customer who has an account on the website of the Internet Shop has the opportunity to view and update data concerning his or her person. After logging in to the Store and selecting the "My account" section, a logged in Customer may introduce changes in his/her personal data.
The Service Provider shall record, secure and make available the content of the Sales Agreement concluded with the Client by sending an e-mail to the e-mail address indicated by the Client.
To Customers having an account on the Internet Shop website, the Service Provider shall make available the recorded content of Sales Agreements. This data is available in the customer panel in the "Your orders" section of the website of the Internet Shop.
The Customer has the right to demand the termination of the use of his data or their complete removal from the database. This should be reported by contacting the Seller in the most convenient way by e-mail or in writing.
Transfer of Personal Data in connection with the Sales Agreement:
- passed on to entities, partners responsible for payment processing,
- transferred to entities and partners responsible for the shipment of ordered Goods.
- transferred to entities and partners responsible for financial and tax accounting,
The Service Provider is entitled to disclose personal data administered by him/her only to entities authorized under applicable law.
11. Dispute resolution
In disputes arising from the application of these Regulations, we recommend the use of alternative dispute resolution (ADR) methods. Dispute resolution methods include mediation, arbitration and complaint boards.

12. Final provisions of the Regulations
In matters not regulated by these Regulations, the provisions of the Civil Procedure Code Act, the Act on Personal Data Protection, the Act on Consumer Rights and the Act on Electronic Provision of Services according to polish law shall apply.
Unresolved disputes arising from the application of these Regulations and in connection with the performance of contracts concluded between Service Provider and Customers, will be considered by the competent court according to the provisions on material and local jurisdiction in accordance with the Act of the Code of Civil Procedure of the Republic of Poland.
